4. Booking and Payment Terms

Bookings are subject to availability. We reserve the right to refuse or cancel any booking at our discretion. A booking is confirmed only upon receipt of a confirmation from us.

4.2 Payment

Payment terms will be communicated at the time of booking. All prices are in UAE Dirhams (AED) unless otherwise stated. Payment may be required in advance or at the time of service, as specified during the booking process.

4.3 Cancellation and Refund Policy

5. Limitation of Liability

To the maximum extent permitted by law, Eighth Element Spa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use our services
• Any unauthorized access to or use of our servers or any personal information stored therein
• Any interruption or cessation of transmission to or from our services
• Any bugs, viruses, or other harmful code that may be transmitted through our services
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

Our total liability for any claims arising from or related to the use of our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

All content, features, and functionality of our booking application, including but not limited to text, graphics, logos, images, and software, are the exclusive property of Eighth Element Spa and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our prior written consent.

We reserve the right to terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the services will cease immediately.

You may discontinue using our services at any time. All provisions of these Terms that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, and limitations of liability.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of our services after any changes to these Terms constitutes acceptance of those changes.
